DocuPacket — Document signing made simple

DocuPacket Terms of Use

Effective date: 2026-10-16

1 Agreement and operator

These Terms of Use govern DocuPacket at www.docupacket.com and its document preparation, delivery, completion, and electronic-signature services (the Service). The Service is operated by Tiffany Paden, doing business as DocuPacket (DocuPacket, we, us, or our). Our mailing address is PO Box 265, Quinlan, Texas 75474. Contact us at admin@docupacket.com.

You means the person accepting these Terms and, when that person acts with authority for an organization, that organization. A Customer holds a subscription account; a Recipient receives or completes a packet. A packet is a collection of documents sent through the Service. A credit is a unit of Service usage, as explained below.

By affirmatively accepting these Terms when creating an account or completing the applicable recipient acceptance process, you agree to them. If acting for an organization, you represent that you have authority to bind it. Do not use features requiring acceptance if you do not agree. Merely receiving an email does not constitute acceptance.

The Refund Policy is incorporated into these Terms and controls specific cancellation, refund, and credit-restoration matters. The Privacy Policy explains our personal-information practices. These documents do not replace a separate agreement between a sender and a Recipient about their underlying transaction.

IMPORTANT DISPUTE NOTICE: Section 15 provides for binding individual arbitration of most disputes and a class-action waiver, subject to its exceptions. It limits court and jury proceedings for covered disputes. A 30-day arbitration opt-out is available.

2 Eligibility and account responsibility

The Service is offered for use in the United States by individuals age 18 or older and by organizations acting through authorized adults. You must supply accurate account information, protect login credentials and access links, and promptly notify us of suspected unauthorized access. You are responsible for activity you authorize, including activity by team members. An organization controls access it grants to its team account.

3 What DocuPacket provides

DocuPacket supports PDF and Word documents, document fields, typed or drawn signatures when a sender includes a signature field, delivery notifications, and completion records. Selecting Finish and submit finalizes that Recipient's response and returns it to the sender's account. When all required Recipients finish, Recipients receive an emailed download link to the completed document.

DocuPacket is an electronic-signature platform, but it is not a law firm, a provider of legal advice, a certified-mail service, a notary, a legal proof-of-service service, or a permanent records custodian. You must determine whether your transaction permits electronic records and signatures and whether additional notices, identity checks, witnesses, notarization, delivery procedures, or retention duties apply.

4 Electronic signatures and link access

Recipients expressly agree to electronic records and signatures before completing the signing process. If you add a typed or drawn signature, you intend it to serve as your signature for the applicable document. Selecting Finish and submit finalizes your response; it does not establish that every field or every packet is a signature transaction.

Current signing access is based on possession of the signing link. Anyone possessing that link can access and complete the signing workflow. DocuPacket does not currently independently verify a Recipient's identity through an identity-verification service or a mandatory email code. Google or Apple account sign-in does not establish the identity of a Recipient using a signing link. Protect links, send them only to intended Recipients, and do not forward them to unauthorized persons. Do not impersonate another person or sign without authority.

Activity records and completion certificates report events recorded by the Service, such as timestamps and available delivery, viewing, download, IP-address, and device/browser information. They do not independently establish a person's identity, actual reading or understanding, legal service, or enforceability. Email systems and automated scanners may affect recorded activity.

Before starting, Recipients may decline electronic signing and contact the sender about an alternative. Contact the sender for paper copies, corrections to contact details, or withdrawal of consent for future electronic records in that transaction. Contact admin@docupacket.com for help with the platform. Withdrawal does not by itself undo a completed signature. Any transaction-specific paper-copy fees or consequences of withdrawal must be disclosed by the sender before consent; these Terms do not authorize undisclosed fees.

Senders are responsible for applicable transaction-specific electronic-consent disclosures, including the scope of consent, access and retention requirements, paper-copy options, and withdrawal procedures. General acceptance of these Terms is not a substitute for any separate consent or demonstration of access required by law. Do not use the Service for a transaction whose requirements the available workflow cannot satisfy.

5 Content and prohibited use

You retain ownership of your documents and other content. You grant us a limited permission to host, copy, transmit, display, process, and otherwise use that content only to operate the requested Service, provide support, protect the Service, and comply with law, consistently with the Privacy Policy. This permission continues only as needed for those purposes and the stated retention periods.

You must have the rights and lawful authority necessary to upload, process, sign, and send documents and other people's information. Obtain required notices and consents. Verify recipients, addresses, permissions, document content, and the suitability of the Service for your transaction.

Do not upload or transmit unlawful material, malware, pornography, stolen information, fraudulent documents, harassment, or content infringing others' rights. Do not circumvent access controls, disrupt the Service, misuse links, scrape private information, or use the Service to deceive or impersonate others. These examples do not limit the prohibition on unlawful or abusive conduct.

At launch, do not upload or enter medical or health information, protected health information (PHI), Social Security numbers, government identification images or numbers, financial-account credentials, or personal information about children. Legal and employment documents are permitted only if they do not contain restricted information. Do not place payment-card details in documents; use the designated payment process. DocuPacket does not currently offer this Service for HIPAA-regulated PHI or promise HIPAA compliance. Future features or agreements do not authorize restricted use today.

6 Plans and automatic renewal

Available plans, prices, monthly credit allocations, and packet file/page limits are disclosed before purchase. Subscriptions are paid in advance. Monthly subscriptions automatically renew each month. Annual subscriptions are paid upfront and automatically renew each year; their included credits are issued monthly, not all at once. Ordinary subscriptions do not include a free trial. If the FOUNDER coupon is available and accepted at checkout, it discounts the monthly Individual membership fee by 100% for the first two billing cycles. Coupon entry is required; it is not applied automatically. It does not discount additional credit purchases and is not available for annual memberships. A payment card and signed agreement are required. Billing cycles follow the calendar schedule shown at checkout, so two cycles do not necessarily equal 60 days. The subscription then renews automatically at the disclosed regular monthly price plus applicable tax unless cancelled before renewal. Review the coupon discount, billing dates and renewal amount before accepting. Availability is subject to the coupon settings and any redemption cap in effect; no place is reserved by viewing this page.

By separately consenting to recurring charges at checkout, you authorize charges to your selected payment method at the disclosed price and interval, plus applicable taxes, until cancellation. We use Stripe for payment processing. Keep billing details current. We will provide the required purchase acknowledgment, renewal reminders, and notices of material billing changes. Any legally required additional consent will be obtained before charging.

Price changes apply prospectively, with required advance notice and an opportunity to cancel; they do not increase the price of an already-paid subscription term. A posted policy change alone does not authorize an undisclosed charge.

7 Cancellation

Cancel through your account or by emailing admin@docupacket.com before the next renewal. Include enough information to identify the account; do not email passwords or full payment-card details. No 30-day notice period is required. A cancellation request received before renewal stops that renewal, even if our response comes later. We may reasonably verify account authority without imposing unnecessary obstacles.

Cancellation stops future renewal charges. Access continues through the paid monthly or annual term, unless you request earlier account closure or suspension/termination is otherwise permitted. For annual plans, monthly allocations continue through the paid annual term. Cancellation does not create a partial-term refund except as stated in the Refund Policy or required by law. We will confirm cancellation. Account deletion is a separate request; export needed records before access ends.

8 Credit allocation and expiration

Each newly sent packet uses one credit, regardless of file or page count. All plans allow unlimited files and pages, subject to technical upload limits of 20 MB per file and 100 MB per packet. Previously sent packets retain their recorded charge. Credits are consumed only when the first Recipient successfully selects Finish and submit. This charge occurs once per packet; additional Recipients do not consume additional credits. Sending, opening, or downloading alone does not trigger consumption.

Individual Plan subscription credits do not roll over and expire at the end of the monthly allocation period, including on an annual subscription. Subscription credits on plans offering rollover expire 12 months after each credit's original issuance. Separately purchased credits expire 12 months after purchase, including when purchased on the Individual Plan. These purchased-credit rules are separate from the Individual Plan's monthly subscription-credit expiration.

All remaining credits, including purchased and rollover credits, are forfeited when subscription access ends, even if their normal expiration would be later, subject to applicable law. Credits may be shared by authorized team members within the same Customer account but may not be transferred outside that account. Credits are Service units with no cash value and are not redeemable for cash, except as legally required. Incorrectly deducted credits will be restored under the Refund Policy.

9 Copies and retention

A Recipient's signing link expires when that Recipient finishes or at the sender's specified expiration, whichever occurs first. The separate completed-document download link expires seven days after its completion email is sent. Recipients may request a replacement link through admin@docupacket.com after verification of access to the recipient email address, provided the document remains available and disclosure is authorized. That verification protects replacement access; it does not retroactively verify the original signer.

Save required copies promptly. Link expiration does not itself delete stored documents. Source documents and completed packets are retained until customer deletion or account closure, subject to the Privacy Policy, legal obligations, and authorized deletion requests. Ordinary deletion from active systems occurs within 30 days, and backup copies expire within 90 days of deletion or closure. The Privacy Policy describes separate retention for delivery records, security logs, and billing records and necessary exceptions.

Cancellation ends paid access at the end of the paid term but does not itself request account deletion. Contact us to request closure or deletion. We do not guarantee permanent storage, and Customers remain responsible for their independent records and legal retention duties. A recipient's downloaded copy or a sender's independent copy is not deleted by deletion from DocuPacket.

10 Suspension and termination

We may restrict, suspend, or terminate access for material violations of these Terms or another applicable agreement or policy disclosed to you, fraud, abuse, unlawful conduct, security threats, or nonpayment. We may investigate disputed or reversed payments and restrict access where reasonably necessary. A lawful, good-faith billing dispute or exercise of statutory rights is not itself misconduct. Where reasonably practicable and appropriate, we will provide notice and an opportunity to address a remediable issue; urgent security or legal circumstances may require immediate action.

If we terminate for your violation, prepaid fees and unused credits are not refunded except where required by law. If we permanently discontinue the Service or close your account for reasons other than your violation, you are eligible for a prorated refund of unused prepaid subscription time under the Refund Policy. We will provide a reasonable export opportunity where practicable and lawful.

11 Service ownership and availability

We and our licensors retain rights in the platform, software, branding, and other Service materials, excluding your content. We grant you a limited, nonexclusive, nontransferable right to use the Service under these Terms during authorized access. Do not reproduce or exploit Service materials except as authorized or permitted by law.

To the extent permitted by law, the Service is provided as available, without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee uninterrupted or error-free service, email delivery, Recipient action, permanent file availability, or the legal effectiveness of any particular document. This does not remove an express commitment in these policies or any nonwaivable consumer warranty or remedy.

12 Limits on liability

To the extent permitted by law, neither party is liable to the other under these Terms for indirect, consequential, special, or punitive damages or lost profits. DocuPacket's aggregate liability arising from the Service is limited to the greater of $100 or the fees you paid to DocuPacket in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, intentional misconduct, gross negligence, liabilities that cannot legally be limited, or refunds and credit restorations expressly due under the Refund Policy. Nothing limits statutory remedies that applicable law makes nonwaivable.

13 Responsibility for business claims

If you use the Service on behalf of a business, that business will indemnify DocuPacket against third-party claims and reasonable resulting costs arising from its unlawful content, infringement of third-party rights, or material misuse of the Service. This does not apply to the extent a claim results from DocuPacket's breach, negligence, or misconduct. We will provide prompt notice and reasonable cooperation and will not agree to a settlement imposing obligations on you without your consent. This section does not impose an indemnity on consumers acting for personal or household purposes.

14 Informal dispute resolution

Before starting arbitration, either party should send a written notice describing the dispute, the relevant account or transaction, and the requested resolution. Send notices to admin@docupacket.com or our mailing address. We will send notices to your supplied contact information. We will try in good faith to resolve the matter for 30 days after receipt. This process does not prevent a timely filing needed to preserve a claim, urgent interim relief, a small-claims case, or contact with a government agency.

15 Individual arbitration and class action waiver

Except as stated below, you and DocuPacket agree that disputes arising from these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA). The Federal Arbitration Act governs this arbitration agreement. AAA Consumer Arbitration Rules apply to consumer disputes, and AAA Commercial Arbitration Rules apply to business disputes, subject to AAA's determination of the proper rules. Current rules and filing instructions are available at www.adr.org.

Arbitration replaces a court or jury trial for covered disputes, and review of an award is limited by law. One neutral arbitrator will hear the dispute and may award individual relief available under applicable law. Fees and cost allocation follow the applicable AAA rules and mandatory law; DocuPacket will pay amounts those rules or law require the business to pay. No consumer must travel to Hunt County solely because of these Terms. Consumer hearings may be remote or held at a reasonably convenient location under AAA rules.

Either party may bring an individual claim within the jurisdiction of an appropriate small-claims court. Either party may ask a court for temporary relief needed to preserve rights pending arbitration, or to compel arbitration or confirm, enforce, or challenge an award as permitted by law. Claims that law prohibits from being arbitrated remain in court. Government complaints and agency enforcement are not restricted.

To the extent permitted by law, you and DocuPacket agree to bring covered claims only in an individual capacity, not as a plaintiff or class member in a class or representative action. The arbitrator may not conduct class arbitration or award relief for persons other than the individual parties. This does not waive public injunctive relief or another remedy that cannot lawfully be waived. A court decides disputes concerning formation or enforceability of this arbitration agreement and class-action waiver. If a particular claim or remedy cannot be arbitrated or waived, it may proceed in court; any remaining enforceable arbitration obligation remains effective. Class arbitration requires both parties' express written agreement after the dispute arises.

You may opt out of this arbitration agreement and its class-action waiver by emailing admin@docupacket.com within 30 days after you first accept these Terms. Include your name, account or recipient email, and a clear statement that you opt out. Opting out does not affect access to the Service or other Terms. If AAA cannot administer a covered dispute, the parties may agree to another provider; absent agreement, either party may proceed in an appropriate court.

16 Texas law and permitted court proceedings

Texas law governs these Terms, except that the Federal Arbitration Act governs arbitration and mandatory consumer protections under applicable law remain available. For proceedings permitted in court under Section 15, the parties consent to the state courts located in Hunt County, Texas, or, if federal jurisdiction exists, the United States District Court for the Northern District of Texas, Dallas Division. This provision does not displace a consumer's right to an appropriate small-claims court or another forum required by mandatory law, and it does not create federal subject-matter jurisdiction.

17 Changes to the Service and these Terms

We may update these Terms prospectively. We will communicate material changes by email and/or prominent website notice, state their effective date, and obtain renewed consent where required. Changes do not retroactively alter accrued claims or authorize charges contrary to the agreed billing terms. A material change to the arbitration agreement will require affirmative acceptance and a new 30-day opt-out opportunity; otherwise, the previously accepted arbitration terms continue to apply to you.

Changes to features do not eliminate refund rights expressly provided here. New regulated-data, identity-verification, or other features will be governed by the terms and notices applicable when offered. A planned feature is not a current Service commitment.

18 General provisions and contact

These Terms and the incorporated Refund Policy are the agreement governing ordinary use of the Service, except for a separate written agreement expressly modifying them. If a provision is unenforceable, the remaining provisions continue, subject to the arbitration-specific rules above. A failure to enforce a provision is not a waiver. Provisions that by their nature should survive account closure, including accrued payment obligations, applicable liability limits, and dispute terms, survive to the extent permitted by law.
